he knows i have been diagnosed with cancer and had to give up my business and can no longer work,he is now more than 18,000 behind and i am forced to give him exactly what he wants,my children, he plans on giving them to relatives because he says he works too much, in the mean time he has been buying cars, motorcycles, new furniture, and vacation packages. I'm in Texas so any help would be much appreciated, and maybe a lawyer who works on contingencie, And yes i have been going through the Attorney General`s Office and doing the foot work for them, i get a payment in time to keep him out of court but only one every 2 or3 months. If you do know the answer Where do i start??

you need to pull rank and put some heat on the case.

well the honor system doesnt work, thats been proven. its also why the state and federal government passed stronger laws for child support; they are TIRED of people not paying for their children.

the arrears still keep adding up.

1) call your caseworker and ask:
--request an enforcement hearing.
--where you apply for interest on the arrears?
--was the case submitted for tax refund intercept?
--was the arrears reported to the credit reporting agencies yet?
--ask why they have not taken his drivers license away yet?
--ask why they have not put liens on his bank accounts yet?
--ask why there has not been a warrant issued yet?

2) sit down and write a letter. in it, give your contact info, case number, his info, arrears amount, the problem and ask them what they are doing about it.

keep the letter short, its more effective that way.

then take that ONE letter and FAX it to the following:
a) BOTH your states Attorney Generals (link is below)
b) BOTH your states Governors (link is below)
c) BOTH your states Regional FEDERAL Child Support Office (link is below)

phone calls are useless; they are ignored, denied and forgotten. mail ends up on someones "to do" pile, but FAXES are effective. its proof you sent it and proof they recieved it, therefor, they HAVE to address it. if you cant find a fax number (most are listed online) then just call them and ask for it.

if you hear nothing in a week, fax them again. fax them weekly if need be. its the squeaky wheel that gets the oil, if ya know what i mean. WHO CARES if you miff ‘em off, just keep at them until the problem is addressed.

3) Report his azz to the IRS (in writing), for he’s supporting himself, somehow. Tell them you strongly suspect him working under the table to avoid a child support order.

4) Report his azz to the Social Security Office if he’s been using others SS#.

5) post his DEADBEAT FACE on a DEADBEAT SITE online.

If you would have asked this question a few weeks ago, I would have said No. But since my boyfriend has just recently been hit with 2 years of back support which was never court ordered to begin with, I would have to say yes. I know it is not fair, and I think what your husband has paid over the years should account for something, but in some states it does not. You need to check your State Laws and see if you can find something out. Good Luck!! I know first hand how hard it is to go through the child support battle. During this process make sure you keep the best records of every dollar spent on the child. You will need it to fight back!!

If the court awarded you child support, you should not have waited until he owed that much but at this point it is irrelevant.

he owes you money and it was court ordered, simply go to the authorities and put it in record that he hasn't paid you anything. Then go get a court date and they will lock him up if he does not pay you the money ordered.

meanwhile, you should be fighting this cancer with all your strength for your children, and yourself.

Forget about what he is buying as it is not your concern, your concern is that you need money to survive while you are fighting your illness and he owes you a lot of loot.

Do not let him slide like you have been doing, show him that even sick, you got a little fight in you

you need to find out if there is a child support enforcement officer in your state. where I live, it works like this. you get an order for child support, and when it's not paid, you go to DHS/Welfare office where the enforcement officer is and file the paperwork. they send letters and such, and if he has not caught up in a reasonable time, paying monthly plus a fixed amount on arrears, they will suspend his license, and we all know what happens if you get caught driving on a suspended license... they also file the paperwork with the IRS and attach his return, and can also attach his assets. find out if there is something like this in your state. it works, and I can attest to that because after I divorced my ex-husband, his first wife hit him this way, and he didn't get out of jail until he worked off his whole amount of child support owed, and they also attached his income tax and she got all of it towards the child support he owed after getting out of jail. good luck! I know it's hard, because I've been there too, but I had to go back through the court and fight.

Nice answers but no matter how many links, people, lawyers you have, unless you can outright arrest him, he can and will just jump through, frustratingly, every hoop possible.

Sorry, but as many could attest, too many, too easily learn quickly that the law can pull the assets, place liens, withhold licenses etc. but in the end, unless he dies with something, and even then, if they aren't fast enough or smart enough to attach it, he'll avoid it if he really wants to.
