My ex and I are trying to divorce and I've been told that we can use the same lawyer in NY state as long as the divorce is uncontested...Is this true? Neither one of us is going to object to the divorce and we have no children or assets..it's a clean break so I need to know if we'll each need our own lawyer to represent us?

Thanks for the answers. I can't file on my own b/c I now live out of state, he still lives in NY though, that's why we need an attorney (someone to rep me in court and all that).

Why on earth would you spend a DIME on an uncontested divorce...Uncontested means you both agree on all considered, you must present the necessary forms required and filled out then they send you to a mediator to make sure this is what you both want and then a date is set for the judge to grant the divorce. Do yourself a favor and DO IT YOURSELF!!!!! You're not fighting over anything and need a clean break, you don't need a lawyer to take your money to do what you can do alone.

Just make sure there isn't ANYTHING you guys have forgotten to put in the papers. Get one atty, save the money and hassle. Not sure of NY rules, but my case was the same thing, but a child was involved. We sat down, wrote all we wanted in our agreement, one lawyer, and didn't even have to go to court. The atty took it to a judge while he was in court on other business, got it signed, and we were divorced... YEAH!!!

Probably OK. My ex and I used one attorney to handle our divorce. It was uncontested as well. Worked out fine, quickly and easily.

If you have no assets and it's uncontested, why not file for divorce on your own without an attorney? Go see the county clerk and ask for the Petition for Dissolution package. Fill it out and file it. Have your husband served and file Proof of Service. If he doesn't respond within the allotted time, file for Default. And that's it.

Yes, it's true. You only need one lawyer but that lawyer can only represent one of you. The other will have to wave their rights to having an attorney. You do that in front of the judge or magistrate.

You can absolutely use the same attorney but whoever contacts the attorney and pays the fee is the party that the attorney represents.
