My husband betrayed n ran with my belongings ….my jewelry, expenses clothes, my gifts everything and left his credit cards bills which I paid on his behalf. It is almost a year; I don’t know where he is? Unfortunately that was a love marriage I have marriage certificate with me. Now I want to rid of this burden relationship. How this could is possible without his sign.

This is really tough going for you as he is untraceable. Unfortunately the provision regarding getting divorce on the basis of this condition has not been heard of as being alive for a period of seven years or more by those persons who would naturally have heard of it, had that party been alive is a very long period of time. The best course is such case is to file a petition for restitution of conjugal right immediately,definately he being untraceable this case will be decided ex-parte in your favor, on the basis of this decree you wait for one year more & then file petition for divorce on the basis of that there has been no restitution of conjugal rights as between the parties to the marriage for a period of one year or upward after the passing of a decree of restitution of conjugal rights in a proceeding to which they were parties. Here again since he is untraceable the decree of divorce will be passed in your favor ex-parte. Now at least with this decree of divorce you can be legally free from him & get remarried. This also a way out in such case, otherwise you have to wait for seven years to get divorce on the ground I told you. Another condition on which you can get divorce from him is on the basis of desertion of more then two years or more for that you still have to wait for another one year then you proceed for divorce on this ground, which again you get decree ex-parte as he won't be able to appear or defend it as he is untraceable. Now I have told you all the ways out & its upto you to decide which way you go about, my suggestion is to fill a petition for restitution for conjugal right now itself, get a decree for this & wait for a year more, then after completion of this year time period you get not only one condition for divorce but actually two as by that time his desertion will also be of more then two years & it will be very easy for you too get decree of divorce from the family court as all these grounds will amount to breaking of matrimonial home irrevertably,for which courts take no time in granting decree of divorce.

You seem to be a confused lot. You have not disclosed under what law and where you were married.If you are living apart for one year, you can apply for a decree of divorce, but if he is not traceable, against whom you will file a case. And who told you that you need his signatures and on what and what for. That would be the case if both of you are going in for a mutual consent divorce. Despite my sympathy with you, I find you need to consult with a Psychologist or Marriage Counsellor and that too urgently.

Just approach the Court with your lawyer. In next stage court will send notices & also publish the public notice. If he does not opproach to court than your divorce case will fiinsh at the earliest. Or If you want to take drastic action than go to Police station & book him under 478.

The ways to track down jerks like your hopefully-soon-to-be-ex are great. Talk to a lawyer. Depending on where you live, you might not just get the divorce, you might recover some assets or send the thief to jail or help some other poor woman he is targeting. He sounds like a con artist, and they rarely exploit just one.

It appears that you are a literate lady and having some knowledge about life. Why you have taken such a drastic step to leave your husband. Study him further and bare some more time and then think of. Most probably you may change your attitude.

First thing ...approach the police. File a complaint for theft.
Simultaneously file for a divorce citing desertion as the reason. Good Luck!!

any way we have to proceed our short life happiness...

apply for divorce ... court will send notification to him if he is not appeared for three time you will get divorce easily it is better now for you. because if he is here and willing to live with you your case will be complicated act immediately and get the things done.

How old are you ? do you have any issue.. better go for second marriage with known person.. because you need some holding ... it must for all ..

You can track him down by viewing the electoral roll or hire someone to track him down. When you have found him, then get a lawyer or solicitor to deliver him the divorce papers.

File abandoment charges against him. You need him to be there to divorce him. In fact you can even find free papers to file online and take to the court yourself to save money.

Its not a simple matter. only a person well versed with the law can help u to be out of this. Please take advise of a learn-ed lawyer and file a suit for divorce.

first you put case against him along with previous story & as per law you can declear in news papers with time period means after one/two months i am going to put divorce paper.
as per standard law you can wait for for 2 -3 years & after automatically it is considered as divorced.
