he filed complained on me that item is not as described, so i refunded him money, now after he got the refund he is not returning the phone, when i contacted paypal they said"well"we cant do much about it..i mean what is this....i checked his ebay activities and he bought this phone accessories seems he is keeping the phone and money, and paypal is favoring him to its fullest..any suggestions..please just give me good advise if you can.

I have had over 100 transactions on EBay - most have included Pay Pal. I have never had a scam as you describe.
In any endeavor where there are many people involved, there will always be someone who tries to screw the system.
And that's a damned shame for the vast majority who are honest - such as yourself - and try to make every transaction the best it can be for both the seller and the buyer. Give the buyer a poor rating and explain why in the comments section.
In the future, do not refund money until you have received the product back. This way you can inspect the product to see if it is in the same condition as you sent it and you will be able to relist it and sell it to a reputable buyer.
(If this buyer ever buys anything else from you - unlikely but possible - send him a credit for the price of the phone instead of the item. What goes around, comes around.)

Be glad it was not something very expensive, here is how it goes. Buyer complains item not as described, you say send item back i refund your purchase price. You dont refund the money before you get the item back, you made a very not wise choice you will have to pay for it this time. Had he complained to ebay they would send you an email, back and forth until both parties were satisfied. Legally there is not anything really you can do, a costly lesson move on. What you can do is report him to ebay, leave him negative feedback saying he got money and kept item. Do not do business with or something like that.

This may not help now but I believe most people do not return a buyers money until the product has been shipped back to you (the seller). In your return policy you should include something that states who is responsible for shipping the item back to you (the seller) then the money is returned. If you didnt have anything like that in your policy or write up paypal probably cannot do anything. The only thing that you can do now is explain in the feedback that the buyer did not return the product even after you returned their money. Warn others and learn from this. Hope this helps

If you printed the shipping label through pay pal then there is a tracking number and delivery confirmation. If it is confirmed that it was delivered then you should have no further obligation. Perhaps the person lives in an apartment complex and the office took the delivery. In any case it is not your responsibility.

you should of asked him to send the phone back first then refund the money. Not much you can do put file a complaint through ebay

That is why I don't use PayPal. I've been frauded out of close to $3,000USD because of their system.

I would report him to e-bay and have them help you they have policy on that.
