If we weren't suppose to be charged how do we rectify. The property was located in Texas.

A lender which forecloses will charge you attorney fees to process the foreclosure, plus taxes on the property until the day the lender becomes the owner.

The lender is correct, and you go not get to rectify, sad to say.

If these were debts associated with the property then you are responsible for them. The bank wants to sell the property at a high enough price so that they do not lose any money - if that doesn't happen, then they still come after you for any excess bills.
