Orphan so that blame can't be put on parents/guardian and homeless as in not in an orphanage. Perfect setup so that the baby is "guilty" of murder and there are several eye witnesses and a security camera.
Can they convict the baby of murder?

It would be impossible to find a baby guilty of murder.
First of all, to be convicted of murder, deliberate intent on the part of the offender would have to be established. Since we are talking about “babies” (maybe someone who is below 5 years old), I don’t think someone that young has the intelligence for deliberate intent to commit murder.
But let’s say that the baby is some kind of “criminal genius” that is smart enough to intend to kill someone… there are still laws which exempt minors from criminal liability. It varies from country to country (some countries exempt those below 15, others below 18, etc). It doesn’t matter what specific age the country’s laws expressly states – someone below 5 yrs old will definitely be exempted.
*in the situation you’re describing (playing on the ledge), the situation would constitute an accident, which is a justifying circumstance to the so-called crime. Even if the court found that it was not an accident but an act of imprudence or negligence (which still makes the offender liable) all courts would still find that the baby had no intelligence to foresee the effects of his actions. There could be no deliberate intent, negligence or imprudence on the part of the offender (baby)
There is no way in the world a valid legal system would allow a baby to be convicted or be liable for murder.

His question isn't "zany" or "sick"... it's the kind of question asked to freshmen in law school in criminal law... LOL
