I was advised to turn in an affidavit and send it in with my petition for legal name change explaining more clearly my reason for wanting the name change. Is there a special format that an affadavit must be written in? I understand that I have to sign it in front of a notary, but do I just type out a statement explaining why I want the name change and then sign it? Please let me know. Thanks. :)

There's no special format but most affidavits consist of:

1. The Court or Cause No. of the case
2. The Style of the court case in your case probably "Ex Parte" along with the number of the court, the county and state.
3. The caption, probably "Petitioner's Affidavit in Support of Name Change"
4. The body of the affidavit, state that you are over the age of 14 and competent to make this affidavit. Give the reasons you want your name changed...
5. Affiant's signature (that's you...)
6. The notary's signature block.

In all probability the affidavit would be attached to your petition for a name change as an exhibit. If you are filing your petition with your local county or district clerk by mail, a cover letter is fine. If you're filing in person, a cover letter isn't necessary...

It's not complicated, but needs to be right.

It needs to state your full name, and that you are over the age required for affidavits, and the date it is being made.

It also needs to state the purpose of the affidavit, in other words "I am making this affidavit for the purpose of supporting my petition for a name change."

Set out any such facts as may be relevant in separate sentences.

For example:

"My birth name is Marion Michael Morrison.

I wish to change my name to John Wayne.

My reason is because no one will come see movies starring Marion Michael Morrison."

or

"My birth name was Jane Doe

I married John Plotkin on May 1 2001, and divorced him on May 1 2002.

I now wish to revert to my maiden name of Jane Doe. "

Have it notarized.

Why were you giving your own money BEFORE you married your husband? What kind of man would ask that of you? You say you did it "just to keep peace." That's a pretty feeble excuse. Why should the peace be disturbed if you didn't?! If you are a single mom, why are YOU refusing child support from your ex? You are shortchanging YOUR child! That money is not for you; it's for the child! What do you mean "we have a special needs baby and she is impoverishing us for some reason or another." Don't you know the reasons? If you don't, you'd better wake up and find out! You need to stop worrying about your husband's ex and clean up your own life first. Grow a backbone and do the right thing. Both you and your husband need to develop good character before you start attacking others.

First, check out your local courthouse and see if they have a form.
Most affidavit require the name of the state and the county of your residence. You also need to request a file # if there is one.
You need to state current name and what you are changing to and you probably need a proof of ID to say that you are who you are... usually a copy of your driver's license that is not expired counts along with 1-2 mail (utilities bill or your lease/deed).

short is better.state your reason in a concise and clear manner.
