Me and my feionce got rear ended on the 9th. The one who hit us lied on her police report and no one seems to care. She admitted fault, but I am afraid that her lies will get us introuble.

Also our lawyer said it would take up to 1 year to settle. Shouldn't it be sooner.

Oh I forgot, the tire marks from her skid out were aprox 148 feet long. She said she just tapped us and didnt think a need for injury claims!

I just want to know if it sounds ok to you?

I want to echo Lori B's answer, which is great.

I, too, tell people to make absolutely sure that they have recovered completely from their injuries before we negotiate with the other side. What if you NEVER recover from one of the injuries? You would need more money for your bills, right? That type if information is very important.

The other party has lied and you are obviously upset. You should be. Is that relevant to your medical bills? No. Is it relevant if you take this trial? Absolutely and your attorney will have a field day exposing her lies in open court. The trade off is settling out of court and letting her "get away" with lying, or taking her to court, exposing her, and risking not winning any damages. Most people take the money.

Well the damage to your vehicle would tell you if she just tapped you. Yes, it could take longer than a year to settle your claim, you need to be concentrating on getting your injuries treated right now, not the settlement. The attorney will work out the falsehoods on the police report. A GOOD attorney will not even begin to settle your case until you are done treating and have reached maximum medical improvement.

Civil law cases typically take 2~4 years to work their way through the court system. Settlement within 1 year is actually on the good side of things.

Collect evidence, including pictures of the tire marks, unless you are positive the police did that already.

It takes so long because the courts take so long. You've been to a lawyer, so all you have to do now is to check the status of the case with him every couple months.

I hope you two feel better soon, and can get this mess paid for.
