well a freind of my sister is visiting at my house and a few days ago her ipod nano recently "dissapeard".

when i took it i traded it for an new airsoft gun (i know bad deal for me but i didnt pay for it) they stole my airsoft gun right of my bed when i went to the bathroom.

Now heres the thing. here friend has to go away on bus because she doenst live here soon. She is threatenting to press charges against me though not very seriously. she has no proof of it and she stole my airsoft gun. Now they have no proof of me taking it all. so can i be charged? or am i in the clear?

and also any legal adivice if the police come and

If you stole it and she reports it and finds the guy you traded it to, you're busted for theft.

What happened to the gun is up to you to sort out.

Wow - you steal the ipod and complain of your airsoft gun that you traded for ....

And wonder if you can be charged?

First place - your sister is no in the wrong BECAUSE YOU LET HER IN YOUR HOUSE.

I had a peace ministry where I helped people ... they broke in my window and stole everything I owned except my underwear - but the police said I could do nothing because they were invited in at a prior date ...

You are screwed - you should have known better ... she not only has the evidence, but; can get the guy who traded you through deceptive trade practices to trade you for stolen goods ...

I would admit fully and do whatever it takes to get her ipod back and let her keep the gun to boot.

Man, this was your sister ... if I were her boyfriend - you would have been vacationing in the local hospital prior to my going on business or on the bus ...

That of course would of occured some time ago for me - I have recently been shown the peaceful solution which I did describe prior to what I would have done for you ... had you done this to your own family let alone anyone else that I was boyfriend to ... but not now - I know the way to peace however, I still have a vivid memory of how I used to be.

You should be ashamed of yourself.

Um, yeah you can face criminal charges. Depends on who exactly you took the Ipod to what charges would be filed. If it was a pawn broker and you signed an affidavit that you owed the Ipod then you face false declaration to a pawn broker. At a minimum, you could face larceny of lost property (yes this charge truly does exist). Also, the person who traded you the gun for the Ipod faces the criminal charge of knowingly concealing stolen property, even if he did not have "actual" knowledge that the property was stolen all the cops have to prove is he "knew or should have known." Such as you give someone $50.00 for a TV that you know is worth $250.00, that sort of thing.

Yes, you can be charged. Whether or not it will hold up in court is another issue. But, you can be charged. If they do call the police, the police will come out and take a statement from her. Then they'll want to talk to you.

In addition to the theft, you can also be charged (depending on what country you live in) with making false statements if you lie to the police officer who comes to talk to you.

Either way, in the end, it'll end up costing you more than both the ipod and the airsoft gun, both financially and mentally.

what is wrong with you? why would you just steal something from someone like that?

personally, i hope she does press charges.

if there is any witnesses, if she knows who sold you the gun, if ANYONE has seen you with it, youre pretty much screwed. you don't always need physical evidence. besides, if you're taken to court, judges have been through psychology classes, and they know when someone is lying - from the way they move their hands/legs/body right down to facial expressions.

apologize to the girl, and offer to pay her back. how would you feel if someone took something exspenive from you? would you want to call the cops? ...uhh yeah, noob.

Right - an open confession in a public web site doesn't count as evidence. The internet isn't as anonymous as you might think.

You stole it, you are wrong. You can be charged. Doesn't matter if they stole something from you firstl.

Seems like your in some deep ****. If shes serious about going to court I would seriously think of getting the cash back for her. If you get fined, you get fined.. i don't think you'll go to jail though! LOL

Go to jail! your a bad person! why would you take any thing that doesn't belong to you! She can't prove anything but dude you should go to jail! You need a job before you take something from the wrong person!

Uhhh, yeah. You just told us all that you are a thief. Policemen/women read this site you moron. They will find you and arrest you if they are willing to spend their time on such a small case. I would be nervous if I were you......
