I don't know exactly how, but they can tell if the infant has drawn breath. I suppose there are changes to the blood because of the oxygen.

In utero an infant obtains oxygen from the mother via the placenta and the umbilical cord.

Upon birth an infant will experience "true breathing." The lungs will expand and allow for oxygen to enter.

In assessing such a matter, the medical examiner will view the infants lungs to see if they have opened. This will indicate if a breath was taken by the infant, which indicates being born alive. If the lungs never opened, it would indicate a still born infant.

The medical examiner can determine if the infant was born dead or alive by the lungs. If there is oxygen found in the lungs, it meant that the infant breathed air.

Air in the lungs is a good, but not perfect indicator the infant was born alive.

However, just because it was born alive (then died) doesnt mean it was murder. There are numerous reasons a newborn might not make it, especially without immediate medical care or even the quality of the medical care, equipment at the facility, etc. Although saying medical examiner, somewhat implies the baby was not born somewhere public.

If the infant took a breath (was born alive) then the aveoli in the lungs would have expanded and the lung tissue would contain air. It is easy to see with a microscopic section.

Couldn't tell ya, but I think in such cases, if it's a question, it's better to assume it was alive. If it was an honest to goodness miscarriage, the mom could have gone to the hospital or something.

If it took a breath, there would be air in the baby's lungs. If it was still born, then there would be no air in the lungs.

They can tell by the baby's lungs whether or not it breathed outside of the womb.
