I really do not know what exactly I need to do, because I received a letter from a Food Lion here in North Carolina that tells me that I have to pay $165 to them by Friday because there was an insufficient check wrote for that amount. My problem is, that check was not written by me, someone else wrote it, I have already seen a copy of it and it is not my signature nor my driver's license number nor my telephone number that was written on it as the information that the cashier is suppose to request. I went to the bank and they told me that the first thing I need to do is close the bank account. But now, what can I do to find that person is will probably keep using my information?

I'm not a licensed attorney, and you should take that into account when reading this, but you shouldn't be liable for a forged check in any state if you weren't negligent in protecting your checkbook (ie, a written order to stop all checks from that checkbook, or just losing it weeks/months ago and neglecting to inform your bank) Seems like the food lion messed up, and you should find someone else to talk to at your bank, they really need to help you more, especially since seeing the forged signature and the information, they still authorized payment of the check. You should pursue the matter of payment vigorously; the authorities/bank/food lion have the burden of catching the guy using your info. If everything your saying is the entire story, something is AWFULLY wrong here, there are many levels of inadequate protection going on, and you should ensure you're not liable.

Yes, and yes. But less and less. I'm a poet and I know it!!!!!!!!!! I have just started using a credit card with a low availble balance insead of a debit card, as I've read about how dangerous it is to use your bank debit card. I still do need to write checks sometimes though. Like for gifts, graduation, wedding. I can't get to the bank to get cash, and would rather not put that in snail mail anyway. Also there are still some business that don't accept any card and want a check or cash. Since I shop second hand a lot, I need to be able to write a check there.

If the bank honored any of the forged checks they need to reimburse you for the amounts taken out of your account. It their responsibility to verify that the signature is indeed yours. As for Food Lion, write them a letter and tell them you did not sign the check.
Report this to the police also. They might make some progress with the info. written on the check.

Close your account.
If you have any outstanding checks not cleared at time of closing, call those people, explain what happened and send a new check or money order immediatly, overnight mail.

Report it to your DA.
You do not have to find the person. A warrant will be issued for an arrest.

Go to your bank, explain to them what is going on and try to get copies of those checks. Oh and close the account.
