Hello everybody, I was wondering if you guys could help me out. I have an ex who heard through the grapevine that I was pregnant. He is 1000% not the father and he knows it. However, to add drama to both his life and mine he's gotten a lawyer and I got a letter saying that I have to submit to a DNA test. I could just "give in" and take the test but I'm so mad at him for doing this and getting me upset while I'm Pregnant(35wks) that I do not want my child violated when he's born...even if it is just a swab of the cheek. I live in Pa and need help, does anyone know what rights I have in denying him this test. Doesn't he have to prove he was with me around the time of conception? I mean really, can anyone just go to a lawyer with a false claim making accusations and force someone to give a DNA sample? Please only answer if you know about this type of situation. Thanks so much.

I know people are probably thinking "just take the test", but it's principle now.

First of all, a letter from an attorney means nothing without an attendent court order. Therefore, you or your attorney needs to write this attorney back and tell him/her in no uncertain terms the following (in your own words):

Dear [name]

I received your letter dated [date of letter] and have taken it under advisement. Let me first respond to your demand that I submit my child to a DNA test.

Not only do I find your suggestion without merit, I also did not find a court order to the effect that I must submit to such a violation of my and my child's constitutional rights. Therefore, please be advised that I respectfully decline your suggestion as to paternity testing now and upon the live birth of my child.

Should you decide at some future time the need to contact me further, please be advised that I am seeking legal representation and any and all future correspondence shall be directed as I instruct in the future.

With all due respect,

[your name]
