My current lease is ending on July 31. In the new lease, the rent was increased by $40, and there is no longer a grace period. The old lease states that rent is due on the 1st of the month, and if not received within 5 days of the due date, a $100 fee will be imposed. The new contract states that the new rent amount is due by 5:00pm on the 1st of the month. Beginning at 9:00am the next morning, a $50 late fee will be imposed. And an additional $50 is due for every week that the rent is late.

Our landlords never gave us a problem with anything. We've always paid our rent and we never really heard from them for the entire year. The landlords know that I use my GI Bill money to pay rent. I can verify my amount on the last day of each month, and I receive the funds electronically within a few days. Therefore, we've been paying rent within the first 5 days of the month for the past year.

Are there laws in PA regarding a grace period?

Anyone else in a similiar situation?

We are seriously considering moving out. The landlord just contacted us last week asking if we were going to sign another lease. If we were such a problem, wouldn't they want us to move out? I know they should've contacted us AT LEAST 30 days before the lease was up.

I just don't know what to do. Our rent will go from $975 to $1065 because we'll have to pay a late fee every month. And moving out would be such a pain in the butt.

Have you inquired of your landlord if he will consider your situation ? Have you explained how your funds arrive ? My guess is that, if you have an otherwise good rental history, they might readily consent to a slightly late payment, as long as you abide by the agreement.

Speak to them courteously and explain what is happening.

I had a $250,000.00 mortgage in PA. The Bank said my payments were Due on the 1st of each month. I was also told that a late fee would be added to my payment if it was made after the 15th. So, Why is it that landlords cannot and will not do the same with rent? The only reason I can think of is all the money they make on the late fees. Greedy B@$t@rd$

No!!! You do not have to give a grace period. My tenants rents are due on the 1st and I choose to give them until the 5th to pay there rent. I have other landlord friends who's rents are due on the 1st and the tenants are late on the 2nd with a healthy late fee. If your lease with this tenant does not specify a late fee and due date do this ASAP and have them sign it. If the tenant does not pay the rent by that date you send them a 3 day pay or vacate notice along with the late fee and any other fee's you have in writing. If the resident does not pay by this time you start your eviction and so on... I hope this gets in started in the right direction and Good Luck!!!

Come on...your landlord has every reason to expect payment when it's due, not 5 days after it's due. Would you wait 5 days for him to fix the heat if it went out in January?

i think u need to discuss the landlord and explain your situation. let him know the grace period was allowing u time to let ur check clear. if he wants u to resign than if he could revert back tot the orignal terms of the lease. otherwise start packing. there is no specified law.
