his ex has been having some girl living with her who i knew from years ago(she dated my cousin probably 15 years ago) this lady living with them is a known drug user crack and herion He has joint custody right now(we have her 6 months out of the year, week to week) This lady is bad news and the mother also has checked her self into rehab about 3 years ago. We have his daughter right now, and she doesnt want to go home anymore but the custody agreement says week to week the mother lives in a neighborhood that is not very nice and brook is not allowed outside over there Should we call CYS and can they really do anything about this person with only hearsay custody is such a horrible process but what can we do please help we want her to come with us...love her like my own.i have raised 2 girls of my own who are 21 and 18.we just dropped the daughter off at camp yesterday afternoon for a week so we have a week to figure something out before she gets back here and we have to send her home

It's very nice that you care so much for this girl, and it sounds like you are trying to do what's best for her and I respect that.

But, she's not your daughter. "We" should not be involved. He is her father and if he feels she is in danger than he should be calling the authorities and fighting for custody. Of course, if you witness something than you should report it but otherwise it will only cause more trouble for the girl if you get too involved.

You mention that the mothers friend has issues. What about the mother? You haven't said that she is abusing or neglecting her daughter. In fact, she doesn't allow her daughter outside because it is a bad neighborhood, so obviously she cares. Do you really feel that children should be taken from their parents if their parents do not make as much money as someone else who wants children?

Try to see if from the mothers side. You obviously live in a nice neighborhood. Well, maybe if her daughters father hadn't left her, she would live in a nicer neighborhood too.

Bottom line, if you want another child then have one, but don't try to steal another womans child because you make more money than she does. That's pretty sick.

Child protective services can help if you suspect something is wrong but it's not a route I would take unless you must. If there has been recent drug activity or suspicion of it in & out of home, you need to try and document proof so that CPS has ground to stand on. Examples, are visitors and what times of the day they show up, how often and how many come and go, and complaints of domestic or from neighbors to police. If you try to say that you knew of past behavior and suspect the child is in danger, you're gonna need to back it up. The area she resides may be because of $$. That's not enough to remove her unless the mom lives in a crack house or next to one to get easy access.

Ask/demand an investigation into the matter at CYS.
Beyond that would be to hire an attorney and petition the court to end the joint custody based on detrimental living conditions for the child.
Make sure you have a paper trail of who was doing what at what time and character background etc...

Contact social services, child welfare division. They will investigate the mother. In the meantime, get as much proof as you can and contact your attorney about trying for full custody with the mother getting only supervised visitation.

boyfriend can ask her costody with the coart.
