Report her to children's services and let them handle it. And go for custody! Also petition the court for temporary custody because you feel the child is in danger. Then the court will issue an investigation. And like the person before said... don't wait. If you wait knowingly while your son is in danger this doesn't put you in a better light with the court. You are knowingly endangering your son without doing anything about it.

If you are trying to get back at her by taking custody of your son then you are in the wrong and you are being selfish. Then on the other hand if you are concerned about his safety and well being because his mother is neglecting him then its your responsibility to take custody . Don't wait for the state to do something cause it may be to late

Go for the custody now. You know how long politics take and by the time that the state catches up with how she is behaving, your son could be in real trouble.

If you wait your son could be hurt. Go for full custody your first and only priority is the safety of your son. Don't wait for the state. By the time they get involved it could be too late.

Why would you wait? the longer you wait the more opportunity you are allowing for something to happen to your son. Go and get him out of a bad situation. If It were my child I would have ad him before I could type the question

You do what's more important for your son. If your soon to be ex-wife is neglecting your son, perhaps maybe you can ask her if you can babysit for her. It's better in the care of his father then in the care of no one. Report it to the child protection services. You can start gathering up evidences (video taping and pictures) when and where she is neglecting your son, and prove to the court that your son is in dangers. so, your son is better off with you.

Here is a link to all the laws of every state. I've spent many hundreds of hours reading laws. You sound like you have a strong case. Remember a lawyer is only as good as his client. Prepare yourself!
