How can a repeated sex offender/child molester get bailed out of jail, but a person who went to jail for fighting once in self defense can't? I've seen people in both scenarios & the child molesters get bailed out every time, but this one girl I know got into a fight & she's not getting bailed out. What's up with that?

The laws are not fair. People have received bail on manslaughter charges. This is not fair to that girl at all.

Bail is a matter of how likely the person is to flee the jurisdiction of the court. It is only barely affected by the severity of the charge. And some one who is already registered with the state, who must inform the state of their location, is less likely to flee, so they are more likely to get bail.

It's not retarded. Most people just don't understand what the point of the bail system is.

But yes, some laws are badly written. This just isn't one of them.

I can't stop wondering about the same question. Laws are very retarded sometimes. But the real problem is that that what we only do : keep wondering. The laws will stay retarded until we start lobbying and addressing the legislature and make the appropriate bills to pass by voting on them so the children can finally receive adequate protection. Just my thought.

Some judges are more liberal than others. Also, the amount of bond doesn't have so much to do with the crime as it does to the person that committed the crime. Bonds are primarily considered on the suspects prior criminal history as well as whether or not they are likely to show up in court (flight risk). Obviously they will look at their ties to the community, employment, ownership of a home etc. when determining bond. The type of crime committed is considered for the general safety of the public. (likeliness of this person endangering the general public).

Nobody to pay her bail, maybe? Sometimes the law seems crazy - did the judge set bail or did she just not have the money to make bail?
