I recently interviewed for a better position with the Union. The position is selected by a point system. Highest points gets the job. I was told that I didn't get the job even though I had the highest points in the interview. I was told I was the only person that they did that to. That every time before and after this type of position was posted they went by the point system. Is this legal?

I have two and a half years experience in the position sought. I have worked at this place for 7 1/2 years. The person the job was given to had one month and no experience whatsoever. The selection committee comprised of two men told me I was bypassed.

If you want more help with that, consider filing a complaint with the National Labor Relations Board. They can tell you if it's an unlawful (and thus unfair) labor practice.

It may and it may not be. If there is something in your background that bars you from the job, then yes it is legal. (A felony conviction for example.) Also, there are plenty of reasons they can turn you down, even if you have the highest points. I suggest that you see an attorney near you. A much more in-depth evaluation of your situation needs to be conducted to tell whether you were discriminated against and could bring suit.

I don't think there is anything illegal about what they did. Unless they are discriminating against you because of religion, race, etc., they have every right to hire whoever they want regardless of qualifications. I wish I could be of more help. Unfortunately, that's just how things go sometimes.

Is there anyway you can call the union and ask the same exact question? They may be able to help you in what is legal .

There may be some reason you did not get the job that is not race or gender related.

If it is a union job, they do as they please, probably a relative got the job.
