do you have to have a fence around a small above the ground swimming pool?

Whether you have a fence or not, if someone falls in your pool and drowns, you are held responsible. Even if you have a fence with a locked gate. If they manage to climb over it and drown, it is your fault.

It is always better to have a fence than not, if only to deter anyone from trying to drown themselves. At least with a fence in place, you should be able to have a chance to catch them before they get in the water.

To find out for sure, you need to check your local laws. I'm sure a call to your local police department will let you know, or if you live in a city, your local homeowners association.

Pools and spas deeper than 300mm and holding more than 9,000 litres in the case of a pool and 680 litres in the case of a spa, which were installed after 1993, are required to be fenced as follows:

The fence must be at least 1.2m high;
The gate must swing outwards away from the pool/spa and be self-closing and self-latching with the latch at least 1.5m above the ground;
All windows opening into the pool/spa area must be at least 1.2m above floor level or have screens or bars to prevent children accessing the pool/spa

Yes, You should if your yard has no fence. Recently I installed around a small above the ground of my swimming pool by Fence Factory Rentals, and now feeling better not afraid about my kids' .

If it is above ground there is no reason to put a fence around it because no one can trip and fall in by mistake.

This should be a common sense issue. If it is a small pool, it probably has small people using it. They could get badly hurt if they decide to use it when you are not aware. Even 5 gallon buckets have warnings on them.

You should if your yard has no fence. If a neighbor child would drown you may be sued, or a least feel horrible for the rest of your life.

I don't think so, if the pool is above the ground. There's no risk at all to fall in it.
