my friend got married last year in India and he lives in UAE (Dubai). his wife left Dubai with her own wish. he is separated for 6months now, tell me how can he get divorce in Dubai without going to India. his wife was forcing him to live in India & he is happy in Dubai. after 5moths of separation she wants to come back.
pls let me know all the possibilities of geting divorce. pls send to my email ur reply.

thnx for ur reply. i am bit confused , tell me
1 whats the total time period to leave seperate to get divorce.
2 is the case to filed in family court before the total separtion time or afetr the required years of seperation.
3 does the indian family court gives divorce on the basis of years of seperation, even if the women is not ready to seperate and the men is ready.
sorry for all th trouble i giving to u, but need this info very badly for my friend.

The best course for this person to seek divorce through Indian Family Court in India. If one year has passed for his marriage he can approach the court for divorce on the condition that will be applicable to his case. In this case the only condition I can see available to him is cruelty, as the condition of desertion requires the desertion of his wife for more then two years & even if they both agree for divorce by mutual consent the time of separate living should be at least of 1 year & in this case they are living separately for only 6 months. As far getting divorce in Dubai by court there you must consult lawyer there as he can only guide if the court's in Dubai grant divorce to Indian/foreigners married according to their personal matrimonial laws. In such cases if there exist legal provisions regarding this which I suppose must be there, then if such decree of divorce is granted by the Dubai court of competent jurisdiction, without any fraud, proper principle of natural justice followed, based on the facts & merit of the case or seek divorce on mutual consent of both the parties, then such decree of divorce will be valid in India.

The answer is as hard as the question. I can not see where the problem lies. If husband is at Dubai & earning a handsome salary what is the problem with his wife.

Before checking about divorce your friend should seriously think about whether he wants to get back with his wife. His wife may have left on her own wish but since she wants to come back he should also think about it. People do deserve second chances you know!
