They come up with it through formulas set forth in the laws.

For wrongful death or other permanent injuries, it's matter of having statistical experts come up mathematical projections of how much a person could reasonably be expected to earn per year, and then multiplying that by the statistical average life expectancy. Not the best system, but the best anyone has yet come up with.

As far as the "wrong pants" type lawsuits, those are purely irrational numbers, which is why the case usually gets thrown out entirely.

This is the reason why mal-practice insurance is so high that it is driving doctors away from their profession. I blame these "accident lawyers" for all the suits. They should be shot. Each state is starting to limit the amount a person can receive per suit. I think this is a good idea. A lot of juries just want to stick it to big business and this is what has happened.

I think there are A LOT of people abusing our judicial system to make a quick buck in get-rich-quick schemes.

Such as:
The woman who sued McDonald's around 10 years ago because she spilled a little coffee in her lap, because there was no label on it to say it was "hot." (All I could think at the time was "Um, yeah, DUH") This fine technicality earned her something like 10 million dollars. Next time you get a coffee from there, look at the styrofoam cup - it says "hot hot hot hot hot hot" all over the darn thing now, you can't miss it. Stupid signs are for stupid people.

The couple who tried to plant someone's finger in a bowl of chili at Wendy's, and claimed it was served to them that way. Thankfully, they got caught.

The family who tried to sue McDonald's for making them obese. I couldn't stop laughing at that one. It's not like the employees kidnapped you from your house and force fed you chicken nuggets everyday for the last 5 years.

The mother who is currently suing the York county school system because her daughter didn't make the cheerleading squad. I hope she loses, badly, it would serve her right. I mean, really, what's happened in this world when you give the message to your children that if they don't get their way, sue? Forget teaching them about healthy competition and not always getting what you want, oh no.

I could go on and on with these stories. Though there are some cases in the medical field where suing was justified (like amputating the wrong leg or something), but about 80% of medical suits are frivolous too. I'm praying for the day where they make it harder for random idiots to waste everyone's time and money.

kind of strange, like that person trying to sure Big Tobacco for around $879 million dollars for selling a dangerous product. But of course it got thrown out because there are plenty of "dangerous" products. Guns, alcohol, cars, cheeseburgers.

I think they cost us all plenty - in both obviously higher insurance rates and not so obvious manufacturing costs because the manufacturers not only have to make their products "idiot proof," but they have to cover all of the costs of litigation and lawsuits, frivolous included, initiated against them also.
I doubt it will change anytime soon because the inmates are running the asylum and there's lots of $$$$$$ involved.

Yep, and in every frivious lawsuit, you have an attorney playing the legal lottery.

well this is one reason why health care costs are through the roof because the high malpractice insurance health care workers have to pay for, in turn those costs are reflected back to you and i in order to pay for their insurance costs. but i am sick and tired of ignorant lawsuits
