In most states, if you are in a month-to-month lease as you are, you are required to give a "due notice".
This is typically 30 days.

If you have not had a written lease since the second year as stated, you would have a verbal lease agreement. To keep things simple, and you out of hot water with the landlord, I would suggest you give him a 30 day notice. That will give you time to find another place, move all the your stuff and leave the place clean. That way you should get your deposit back within two weeks.

usually after a year lease ends and both parties stay on the lease reverts to a month to month lease with the terms, now certain states under a month to month after a year may require 60 day notice
so either a full month notice so give notice now to be out at the end of august or 60
side note: take lots of pictures on how you leave place, after five years you will have allot of normal wear and tear which the landlord if a pain will try to collect from you either by your security deposit or suit in court saying it was damage

The other posters are quite correct. However, I would caution you that the notice is not actually 'thirty days". It's thirty days from the start of a rental period, which in your case is one month.
You are advised to give your notice right before the end of any particular month, at the latest, assuming your rent is due on the first.
As an example, if you were to give notice tomorrow, in the middle of July, it would have the same effect as having been tendered at the end of July, and you would be expected to pay August's rent in full and also be removed from the apartment by the end of August.

you will be legally bound to whatever written conditions & restrictions you agreed to...they carry on to the month-to-month contract.
give 30 days notice, clean the apartment, repair any damages, and take pics of everything - so you can prove the condition you left the apt in...and can get your deposit back.
also, it is advisable to do a walk thru with your landlord before you leave, so that they can also see the apt before you leave and turn over keys...
if you do not get your deposit back after 14 business days...file a small claims court action against them, bring you pics as proof as to how you left the place.
good luck :)

living with no lease means ur living month to month. so you should give 30 days notice of your date you plan to vacate. leave the house in broom swept condition. since u have been there for 5 yrs exect to loose some of your security to cover ur normal wear and tear. maybe try to arrange a pre move out inspection so u have a chnace to repair anything ahead of time in hopes of getting more of your security back.

You are required to give 30 days by law, but if you want a good rental refrence I would say give at least that not more...you don't want them telling your future landlord you skipped out on your place and screwed them over.
