I bought some noodles that expired 2 months ago and got sick and threw up. I still have them. How do I go about getting paid for this happening to me by the noodle company?

you can't. you ignored the expiration date, so the companies aren't liable

If you bought them off the shelf and they were expired AND you can prove it you might be able to collect something from the store. The noodle company is in the clear seeing as they posted an expiration date.

Generally an upset stomach isn't serious enough to collect anything. You would have to be sickened to the point you needed real medical intervention AND can document it.

i thought that something you had to cook could never expired. are you saying that you purchased noodles already cooked and kept them in your refrigerator for two months? did you cook the noodles yourself? Then are you sure the water is good in which you drained the noodles.
these noodles were they in a can that was dented
look on the can or box for the 1-800 number and call them they will ask for the numbers on the label of the box or can this is called serial identification.
please take a laxative to get it all out of both ends

If you bought them after the expiration date, or ate them after the expiration date, then you are considered to have assumed that risk and your lawsuit will be dismissed.

Tort law only protects where you have done nothing to create the risk of harm. So, if you bought new food (before the expiration date) and got sick, that's something you can sue to recover, based on either negligence or product liability.

But if you ignore the expiration date, that relives both the store and the manufacturer from any liability.

Write the manufacturer and or company of that product and fill them in on all of the gory details. Tell that this incident has shaken your trust in their product. Then, ask them what is the next step, so you can get closure. Or, something to that affect. Don't threaten them. Make sure that you can prove your claim and let the PR department do the rest. well you could get you a lawyer and yes keep them. But you may loose for the simple fact you eat them after the expired date, which relieves them from all responsibility. Because that date told you in layman's terms, don't eat me after this date. Sorry

Well it depends on how serious your sickness was and whether or not being ill was a source of troubles and obstacle to perform the usual daily activities. Nothing was wrong, then no worries. Keep up.
