yes, but these movies were never made for DVD
they are transfer from 8MM

Under the circumstances you describe, resale of a disc that is a transfer to DVD presumably without the consent of the copyright holder, the copy is illegal to begin with, and your resale of it constitutes copyright infringement.

The answers above would only be correct if the DVD you purchased was an authorized and non infringing product.

then yes it is probably illegal to sell. Transfering a copy is still a copy. By taking the 8mm to DVD, he could make hundreds of DVD's and sell them the same as if he made copies of a DVD to DVD. Check with eBay they are pretty up with the copyright laws.

If the seller originally bought the DVD, then they have the right to re-sell that DVD to someone else. The license to use (play) that DVD and its contents would transfer with the physical sale.

If it is an original copy then yes its legal, you may resell software, books, albums or CD's as long as you are reselling the actual media. You are not allowed to copy any of those things and sell them.
