I was weondering? my friend had a baby no long ago and there was a possibility it wasn't her partners but her partners best mate's they both knew they could ahve been the father so her partner got a DNA test done shortly after the birth, which said he was not the father, no the other guy wants a DNA test done aswell, my friend is rather upset about the results and is very angry that the other guy now wants a DNA test she has refused but will she ben taken to court? will she have to get it done? or could she fight it? she doesn't want money off of the guy or his family and she has said if they want to see the baby they can? can anyone help? if she went to court could she ever win?

the guy doesn't want to be involved and the lasy's partner wants to father the child and has done since the child ws born, it was 50% chance of being either his or her partners and her partner is not the father. The two men weren't actaully close together, her child was born tiny they thought it was full term which i would have been had it been her partner but now think the child was preterm by at least a month which makes it the other guys? if the guy wanted to be involved i would understand but he doesn't and the lasy doesn't want money off of him so whats the point?

First of all, why is she mad that the other guy wants a DNA test? If she is scandalous enough to sleep with two men so close together, then why not a third, fourth, or fifth? The guy has every right to want it and it sounds to me the reason SHE doesn't want it is because she is also afraid it wouldn't be his. I think she has no case, any judge is going to look at the fact that there are numerous possibilities of fathers and that the DNA test needs to be taken.

He can take her to court and demand to get a dna test done. The biological father has the right to his child. The judge will give the father and the baby a test, so I don't know what you mean by her winning. The baby wins by knowing who her dad is. The baby has that right!

If the court orders a DNA test, she does NOT have the right to refuse. If she does, she could be held in contempt of court and face either a big fine or jail time. If he asks and she refuses, he can take her to court to get it done. She *could* fight it, but not only would it be expensive as all get out, it'd be like pushing ice cream up a hill with a stick - meaning pointless. She won't win.

If he could possibly be the father then yes he can take her to court and get a DNA test and she cannot refuse then. It is his right to know whether or not he is the father or not and his right to have participation in this childs life if it is his.

The court can decide on a paternity test, and if they tell her to have one done, SHE MUST.
But, since she slept with "2" men, in a short time, and "1" is known NOT to be the father, the "2nd" man has the right to prove that is it his.
Is she refusing the test because "2" may NOT be the father, either???

It's nice that fathers are fighting to take care of the (their) child. I hope it's not just bragging rights, and or wanting control. Who does the mother love, and who does she think would be the best provider for the child? I know of multiple parent families that are working out great. They put the child first always.

It would not be necessary for the mother to have a DNA because she knows for sure she is the MOTHER.........
