What if the parties involved use contraceptives or are gay? Why should they go to prison then?
Just for being "EUWWWW THTS GROSS!!"?
Should "gross" carry a prison sentence? if thats the case haven't most people done something gross thus deserving to go to prison?

Legally though incest is specifically defined in law as sex between relatives of any age not minors. Also the likelihood of contraceptives failing is pretty slim, and is not even worthy of consideration because even if it failed the likelihood of pregancy is still slim and EVEN if pregnancy occured "mutations" take multiple generations. multiple generations of incest in itself is unlikely, let alone multiple generations of failed contraceptives leading to pregnancy. The chances of a failure of contraceptives combined with the slim possibility of "mutation" can't conceivably outweigh the detriment caused in the long run by banning it to the individuals involved because surely that would harm people and if it were legal it only might in theory and only under very unlikely circumstances. By it being illegal society is directly responsible for harming others, by allowing it society would not be. and an incest child should not be considered a lesser person, they wouldnt exist if not for it.
