The problem is that my husband and i have separated but i am yet to file for divorce. I will be filing for divorce in about 1 month. In the meanwhile i need to get my daughter's passport made urgently. Also though we married in 2005 we never got the marraige registered so we have no marraige certificate i only have the child's birthcertificate. he would never agree to get my child's passport made since he needs her custody. What should i do to get a legal passport made without my husband's knowledge?

You can get your child’s passport made even without your husbands consent. In such a case you should have a valid passport, the birth certificate of the child & you have to give affidavit as provided under annexure 'G' DECLARATION OF APPLICANT PARENT OR GUARDIAN IF PASSPORT IS FOR MINOR (one parent not given consent): IN THE FORM OF A SWORN AFFIDAVIT BEFORE JUDICIAL MAGISTRATE ON NON-JUDICIAL STAMP PAPER
All these along with the passport fee applicable.

To get the Passport of your child it requires both Mother's and Father's signature on the Application with their Passport copies. For exact details you can contact the customer service at Passport office in your city.

You do not need you husband's permission or participation to get your daughter a passport. You need a certified copy of her birth certificate( get from the county of her birth ), which you can also do on your own. In the States go to the Post Office for the forms( for passport processing ). You can get her photos at a Walgreens for less, plus you can make up something for your daughter, maybe tell her you want a special picture of her ( don't mention the word "Passport" and it can't be repeated) The longest thing is the wait for passports, about 4 - 5 months now, to get it processed.

My answer will be based upon assumption, based upon how the question was written.

Why do you need to have a passport made w/o your ex's knowledge? Based upon your question of trying to be a sneak, I have to assume that you are trying to move out of the country so your ex cannot see his daughter. How old is your daughter is what does she think of what you are trying to do.

Of course if this is your plan, I would assume that you would still try to have it so he has to pay you child support even though he cannot see his child.

Overall if this is true, I have to say that they need to pass a law that pretty much says, in order to collect child support, the dad has the have the ability to see the child, if he so chooses to.

Also if he finds out what your trying to do, he could goto court, saying your trying to leave the country w/o his knowledge & fight for custody, & possibly win.

However I could be wrong, & there could be physical or emotional abuse, but even if that was going on, most people are not trying to get a passport.

As far as I know you cannot. When I got a passport for my child my husband and I had to both be present and sign the forms in front of the postal worker (we got our passports at the post office). You also cannot leave the country with your child without his permission if both of you have custody. This is in place to prevent a parent from kidnapping a child to keep it from the other parent.

Wow, what an awful thing to do to your child and her father. Fathers deserve the same rights and the ability to bond with their children as much as mothers do. Leaving the country without her father's knowledge is a sick, selfish and twisted thing to do. If I could, I would inform him right now.

if you have a court paper that say's taht you are the solei custody of your kids then not problem.
