Parents are a different matter; as is if one of the people has been judged mental incompetent to make such decisions (Example: one of the people involved has Dow's Syndrome). If either person says "No" then it becomes rape and that is definitely illegal.
This answer is also valid if the underage people are of the same gender as well.

Yes. Most states except maybe Utah because you can get married really young there. But it is rarely prosecuted anyway unless one of the parents finds out and has proof.

NO IT IS NOT. Because they are both underage, neither is responsible for their own actions. However if one is even slightly over the legal age and the other is slightly under..all hell breaks loose!

More information please there are a lot of variables to this questions like how young, are you both exactly the same age etc. but if your both under the age of 17 and both the same age no, but you both could be called incorrigible
