I have heard some crazy stories about hackers formatting their hard drives so that the fbi doesnt have proof that they are holding illegal programs and such. Wouldnt that be destruction of evidence?

They can get what they want off a formatted drive
Even if you formatt it 10 times

It would only be destruction of evidence if they confiscated your PC and then you went in and formatted the hard drive. Easier said than done.
