I am in a complete outrage and I just don't know what to do about this situation. I have been renting a 3 bedroom apartment in West babylon for the past year. A very close friend of mine who is black was visiting me from NC for 10 days, I told my landlord a week in advance that she was comming, and he had no problem with it. When she came just today he freaked out becaust she is black and made a horifing statement that first you brin spanish people into my house(my husband is hispanic)Then you bring black people in. He told me not only can she not stay here, but I have to find a new place to live! I just don't know what to do about this, if I fight him what stops him from raising my rent and chasing me away, at the same time I feel I have an obligation to fight for what is right. Please help!

No, you cannot be evicted based on the race of your guest. That's a violation of federal civil rights laws.

If the landlord was OK with you having a guest, then the race (or gender or religion) of that guest cannot make a difference, legally.

No, your landlord cannot evict you based on who you bring into your apartment, unless there is some form of restraining order against a specific person. That has to be issued from a court and must be a specific person, not a general race.

I very strongly suggest you take this issue to your local housing authority ASAP. For your sanity, I would also suggest giving this clown a 30 day notice. I'm sure it must make you and your husband's skin crawl to give even a dollar to this hatemonger. Good luck.

No, you can't be evicted. It is against the law to discriminate in housing because of race or ethnicity.

I don't know what the law says about a house guest - he might have grounds to evict you for having an unauthorized person living with you, even if he said okay, it will be his word against yours.

But you don't even have to bring that up. He made a comment about your hispanic husband and then evicted you - that is enough to bring a lawsuit against him. You can probably get a lawyer to write him a letter telling him he is probably in violation of the law and that will quiet him down.

If you have a lease, by law, he cannot raise your rent, until the lease is up. As far as having a black friend stay there~if the person was just visiting and not living there, I doubt they could do too much. They could not kick you out for it. Now, if you moved your friend in permanently and the friend wasn't on the lease, yes, they could do something about it.

This is a real outrage. If you do not want to sue him for unjustly evicting you based on racial bias (which is by the way against the law), you can contact local newspapers and they will raise hell. However, it does not hurt to check out places you can move to, since I doubt you will ever have peace at this place nymore.

i want to apologize for this idiot!
i would immediately start looking for another place to live...he will probably give you a 30 day notice at the end of the month anyway.
look in your white pages for Renters Advocate...call them and ask their advice....however, in most areas of the US a landlord can raise the rent when he chooses to.
I live in california and in our city - a landlord can give you a 30 day notice to vacate and not have to give you a reason.

so---is it legal? probably not
will he do it? probably
and you should just move....you'll be happier.
ps--make sure if you do move--clean really good and take pics to prove no damages so you can get your deposit back.

Eviction based on race - NO. Are you a good tenant? Do you pay your rent on time? Lots of questions....

Like you said, your landlord will probably make your life hell just to get you out. I suggest you relay the details to the NAACP. If your case looks good they may provide free legal assistance.
