My friend purchased Zelda: Twilight Princess for the Wii. Since then, the disc has gotten scratched and will no longer play in the Wii.

Is it legal to use BitTorrent or any other P2P service to download/burn the game again and destroy the original hard copy? (I understand that if you do not own the game, it is illegal, but my friend already purchased the game at the full retail price.)

Generally, once you have purchased the license to own and use a product (like the game), you are allowed to make copies of that for your own personal use.

Without having researched the specific precedents, my initial thoughts are that downloading a copy would fall within the scope of your license, since your actions are only the copying to your computer, which is allowed by the license you purchase.

In other words, I'd be confident taking that case and arguing the license allows for that as legal use.

Technically, no, that would be making an illegal/infringing copy.
