Maybe not marshall law exactly, but under a new presidential directive, Bush can declare a national catastrophe which will him near dictatorial powers.

The real life chances of wide spread Marshal Law is slim to none. The US would have to be invaded for a presidential act of marshal law. However, if there was a terrorist act, limited Marshal law may take place by using the National Guard to control the impacted area. This type of Marshal Law could be declared by the Governor responsible for the state.
