I recently worked for a guy, doing landscaping. I worked for him 2 summers ago and everything went great. I just graduated college and needed an interim job before starting my career on June 1st. I worked for 3 weeks and never received a paycheck. I worked 81hrs at $9 an hour = $729. I have called him at least 4 times a week since May 27th (the day I should have received my first check) and every time he tells me, "The money is being processed, we will have it to you tomorrow". No exaggeration, this happened 20 times. Well, recently he changed his phone number and didn’t call me. Someone else told me his number and I called him, same story. I am not the only employee he has done this too this summer, there are three more. What should I do?

I must note that he just runs the business and is a lawyer on the side......

Get in touch with others he did this to
Contact a lawyer
Class action suit
If payment was always done without taxes being taken out, "under the table", it's hard to prove employment. No application on file, no employee record, no employment history, no time card.
If that doesn't work, retaliation.

All four of you should go stratight to the department of labor (www.dol.gov will have a link to your local office.) File a claim for back wages.

Make sure you bring any documentation with you to support your claims - documentation of hours works by day/week, etc.

State Labor Board -
Forget suing , lawyers cost more than you recover .
State Labor Board in many places will take the complaint , make the collection then mail it to you .

1. Threaten to call the labor board if he doesn;t pay

2. If he doesn;t pay then, All four of you should file suit in small claims court and also report him to the labor department

if you can afford to sue, and you and the other employees who were ripped off have some good proof of your work (start by recording one of your phone calls). Then yeah, sure, sue...
Check how long he can legally delay payment though and wait that long...

First call your local Department of Labor.

If they can't help, your next option would be to sue in small claims court.

Sue that jackass in small claims court. What a flaker...you need your money and he's coming up with excuses. If I would you, I would sue his *** and get the money that you deserve.
