Why don't you just learn from your mistakes and give your wife the financial settlement she deserves instead of trying to wimp out of your responsibilities?

In Australia, the family law system is a 'No Fault' system. This means that the reason for your separation (unless there is evidence of violence and/or abuse) is irrelevant. So in terms of any financial settlement you decide upon, your emails won't have any relevance. She may decide to go public with them anyway, which will work against her as the courts take a dim view on vilification, however, that may be the penance you have to serve for engaging a mistress in the first place. Talk to a lawyer. You should then be fully aware of your rights.

In your home with your wife, she can print anything from any computer in you house. Weather or not she can use these emails against you is a mater of privacy. It would not statically be unusual for a spouse to use such correspondence against the other, because it occurs in the same household and can be used in a court for the basis of adultery to dissolve a marriage.
As far as her going public with this evidence, I am not sure, but I believe she could. However in a divorce court it would be evidence on her side to dissolve the marriage.

Even though most laws don't allow this to be used against you, judges are people with morals. In my divorce, this kind of information was used for property settlement and custodial decisions by the judge. You can appeal that decision if necessary in which case you are more likely to get a "legal" rather than "moral" decision.

Yes!, she can use them against you. Why leave her only after she found the emails? Why not leave when you decided to fool around? Is it wanting to have your cake and eat it too? Face it your actions were caused by you, now you'll have to pay out because of those actions. Were you trying to get caught? Keeping 16 months worth of emails. Man, no amount of money will be able to repair the broken heart you gave your wife. Why fight it, pay up and pray she forgives you oneday, because what goes around, comes around. Not sure what country your in, but 16 months of emails are sure not going to make you look very good and if used against you, things will definitely swing in her favour.

umm... yeah she can... and nothing can stop her from using it if she has a copy.. you should be discreet if doing anything like that.. even try deleting them. The problem is the financial settlement, she will use whatever she can to try and get money.. silly silly..... learnt your lesson yet?????
