In some states yes it is illegal, however it is over looked since the police are busy arresting rapists and murderers and child molesters rather than cheating wives and husbands. Of course if you'd like we could let all the murderers, rapists and child molesters OUT of prison to make room for all the men and women who cheat on their marriages.
And contrary to what S.R. Reeves has said. Prostitution IS legal in Nevada and Alaska and other parts of the country as well.

It's not illegal, but some states require a claim and/or proof of infidelity in order to file for a divorce.
Cheating by way of prostitution (paying anyone money for physical sex), on the other hand, is illegal, because prostitution is also illegal.

No it is not a crime but it is a sin. It is also grounds for a divorce and an easy way to have a prenuptial agreement voided.
