We all know that Child Porn is bad, etc. etc. blah blah blah.
Everyone talks about how evil it is and how it exploits children.
But i have a question, what if the child WILLINGLY is in the pornography What if they are the ones taking the pictures of themselves and posting it online and such? What, legally, would happen to the child that is doing that? This is a serious question and i want only serious anwsers with proof. This is very important. Thanks

And i know that the child would be mentally damaged and such.
But, and in this "hypothetical" question, the teenager has had NO Adult help in this process what so ever.

A child cannot consent to being in a pornographic movie, photo or other content. Believe it or not, if two kids have sex and they are under the statutory age of consent, they are BOTH guilty of statutory rape. In the example you give, the "pornographer," the one taking the pictures or whatever, would be guilty of disseminating pornography. And the participants would be victims because they cannot consent. Regarldless of how old the perp is.

The crime is serious not only for the safety of the kids participating, but for the fact that the content becomes pornography online and gives the maniacs who look for that stuff more material. This is a very good question though. But if you know kids doing this, you have to stop them.

Yes, the children CAN be charged. If what you are saying is true...that they are not responsible for their actions...they could not be charged with ANY crime. This is simply not the case. In statutory rape cases, if both are under the age of consent, they are both guilty of statutory rape. Most states make it more of a crime if the older person is more than a couple of years older and the younger person is under a certain age.

Then that child needs professional psychiatric help, and a good physical check-up. Children who act out like that have usually been molested. You want proof? Sorry, but when my ex molested our daughter and his step daughter he didn't leave you pics or anything to look at.
But is the word of a mother of a molested child enough? Kids usually go one of two ways after that. They hide, and don't have any contact with that sort of behavior, even dating, or they go the opposite extreme and become very oriented to sexual behavior.
But I have yet to hear of a child who was distributing their own pornography. No matter how "willing" they might look in your movies and pictures, they aren't the ones behind child porn. Adults with mental problems are.
And not "blah blah blah", this is a serious problem, and if you know someone doing that, they need help. It does exploit children. And any child doing that has most likely already been exploited and messed with.

Look, kids the age we are talking about are not going to be taking porn shots of themselves and posting them on the Internet!

I know several police, one in Keene, NH, who often pose as children on the net. They have made a lot of arrests so be careful. You really don't know who you are communicating with!

I don't see any evidence of what you say, though I am sure there are some over 16 who are in the chat rooms, and occasionally on-line!

The child's parents are the ones who are most likely to answer for their children.

Child porn is a business. It isn't usually done willy nily by some 10 year old! Pre=pubescent kids would hardly want to be involved in anything like that as they have no interest, even if they could!

My proof is 16 years of investigating child abuse!

Our laws presume that children cannot consent to these things, that it is not possible for them to be "willing" to engage in this conduct, due to their young age and inability to understand the consequences.

Assuming for a moment that your hypothetical would ever happen--which is highly unlikely without adult involvement--the children could be charged with a crime in juvenile court. Most probably, they would be found, at a minimum, to need the protection and supervision of the court and might find themselves in foster care or other county care.

EDIT FOR YOUR ADDITIONAL DETAIL - if they are teenagers, it is all the more likely that they will be declared wards of the court and put under some sort of probation/supervision. For more insight on this, read up on Tracy Lords, who made dozens of porn films as a teenager. "Consent" and "willing" do not apply to minors.

It's illegal. It makes no difference if the child willingly consented or not. Minors do not have the legal capacity to enter into contracts. If they took the pictures themselves and posted them, without assistance or encouragement from anyone, then they will be charged in juvenile court and sentenced to a rehabilitation program, rather than criminal charges for adults that do these things.

First, the child would not be charged as a criminal as the poster above stated as they cannot be responsible for their own actions.

The person receiving the most punishment would be the parents or guardians as it is their responsibility to monitor their childrens actions.

If they can prove the child did it themselves, without any additional help, the punishment would not be as severe as if the parents were an influence. Not to say the punishment wouldn't be great, just less severe.

hhhmmmm.....good question! bu i think the cops would investigate if the child is on this by themselves first. if they arent the adult would be charge for being a rapest etc. etc. and if the are theyd probaly get sent to camp or some thing to straighten them out...

because they are not a legal adult when they are ages 14-16 (they are when they turn 18...then they are legally and adult) therefore they cannot make that decision for themselves...
