Hello! My lease was up on July 1st, but our landlord left for the month and will return in August. I have heard that in New York state leases automatically renew for another year once you surpass the expiration date of the lease. We recently found a house we want to buy, but obviously if we are locked into another year at our rental that could make things more difficult. We haven't signed a new lease yet. Are we currently month-to-month until we resign or are we in for another year? Thanks for your help!

I just went through my emails from the landlord and she emailed me on May 21st to "remind her on or just before July 1st to have each of you initial
a new agreement for the forthcoming lease which begins July 1st." Would this constitute giving us notice?

Under NY law, it will only renew if there is an automatic renewal clause in it, AND the landlord gives notice at least 15 days but not more than 30 days before the tenant has to take action to NOT renew.

In other words, you can't accidentally sleep through the renewal and be bound to a year's lease.

** her email being on May 21, that's outside the maximum of 30 days. It is not effective notice during the 15-30 day window.

** actually, if her email indicated "a new agreement", it doesn't sound like it even refers to an automatic renewal at all. I think she was referring to a new lease, which isn't effective at all unless signed.
