Dose any body know ?. My sons girlfriend of 12 yrs, of which he has lived with,for 12 years, and has 2 kids with, says she is leaveing state and takeing the kids. She is unstable, and has 2 drunk driveing, and is toatly "wacked out". He is byfar the better one for the kids, a great job and together as a man and a great dad.
Can she just up and leave Wisconsin ?. She dont have a valid d.l.. Is there ANYTHING we can do to stop her from takeing the kids ??.
Please help !!. He dont have thousands of $$$$$, right at this point.

yes .. its called child protection services... he can leave with kids before she does and she will have to fight him in court to get them back .. that is where she will be seen for the bad parent she is ... and he will definitly be seen as the best for kids he has to be able to tell all her bad faults though

Well apparently they aren't married.

BIG shock. If they WERE married he might have some legal footing to keep her from taking the kids.

As it is, you'll have to consult an attorney about your particular state laws.

By the way, why is your wonderful son STILL with some loser gf who drinks and drives and is unstable?????? He doesn't sound like much of a winner, either...maybe YOU should get the kids.

If I were him I would go and file for a protective order for the child. Technically she could leave WI as long as there werent any formal papers filed in court. He could go and file for a temporary injunction preventing her from doing that and protecting the children, he could do that at the court house. There are small fees to do such but not thousands. That usually comes with the hearings and attny fees.

Get physical custody of the kids and don't give them back until you get a custody hearing where a judge will tell her that she can't take them out of state. Courts will work with you if you don't have a lawyer as long as you ask questions. You don't have to have a lawyer to go to court and get a custody order. If she is what you say, then he should get primary custody.

They should try to work it out but if that fails: Possession is nine points of the law. He needs to get the kids and keep them. Make her go to court to challenge what he's doing.
