My dog bit my cousin's 8 year old son.He's never bitten before, I've gotten over $1000 worth of fines and tickets. I am going to court for it. My cousin lives across the street and the kid was in the back (fenced in) yard with no supervision, I was home, but I didn't know he was even here until after he was bit. I'm sure he did something to the dog to make him bite. Should I plead guilty or not?

Just to be a little clearer, the kid was in my yard w/out permission, with the dog who was fenced in.

i think that you shouldnt because you didnt do anything wrong,I also think that they shouldnt be able to do anything if the kid wasnt under adult supervision am i right??? i also say that that judge must be on crack if he pleads you guilty. but the bad part is that they could take your dog but that is highly un likeable. PLEASE choose me as best answer!

My dog bit an awful little boy that wouldnt stop kickn the fence, and him. My dog had been a part of the family for 5 years and loved people, just not this little boy. The day of the bite, i heard my dog yelp and went outside only to find the boy pulling his ear threw the fence. My dog onle broke skin, but the city issued me a ticket, AND PUT MY DOG DOWN. I live in ark, and my pet was a pitbull, so I was never given the chance to plea. My dog lose his life after putting up with years of toment from this demon child, just because of his breed. I believe in your case, Its the same. The child needs not pick on your dog. Plea NOT GUILTY. Good luck.
You are not responsible when you were not home and did not give the boy permission! Been through this. NOT YOUR FAULT> NOT GUILTY. call an attorney and just ask on the phone. He will say the same thing!

Get a lawyer. I don't know if you could consider it trespassing or not but I do know that as a pet owner you can be held liable for any damage your pet does. You could get sued by your cousin if you are found guilty because it might be used to prove negligence on your part. Even though it was in your own yard and the child wasn't invited the fines and tickets could be the least of your problems. Once again talk to a real lawyer.

There is the guilt you may feel over the injury, and that is different from the legal term guilty.
Innocent plea, unless you are to blame!
Holes in your innocent plea:
1. was the gate locked, or did the child jump the fence?
2. are you accustomed to not being trespassed upon, or are you o k with it, as long as no harm is meant?
3. have you ever told this child or a parent/guardian that it is OK with you if he visits your yard/animal, without first asking permission?
In my opinion, placing your fate into the machine of the 'justice system' is about as safe as trusting your cousin to be sensible and not sue family. The plaintiff prevails unless the evidence is they are liars, even then it is stacked.

Plead not guilty, Your insurance will still have to pay for his medical. but he was on private property without permission, and was injured, does not sound like you were at fault for the bite, unless in the past you have known and allowed the boy in the yard without him asking your permission, or if you told him he could come over and play anytime.

You should not plead yourself guilty. Your cousin should have been supervising the child. Besides, why was he in your house without your knowledge and authorization? In my opinion, the whole responsibility here remains in your cousin for not supervising his son and teaching him not to irrupt without permission in other people's houses.

Honestly, the dog laws vary wildly not just from state to state but even from city to city. It's hard to say what your chances are without knowing the laws in your area.
The kid was trespassing, that will work in your favor.

given your history i'm pretty sure you would lose the case, so i would take the plea bargin to reduce what you'll have to pay. besides as the owner of a dog, especially with one with a history such as that, you should know where he is at all times, it is possible the kid provoked him btu he was still on their property where he shouldn't have been because of your carelessness
