My child is now 13 years old, my ex never asked for child support, now that I am coming in on some money for an inhertance, my ex now has open a case (California), right now I am currently unemployed and I am on AFDC, so he can not get any money from me. The child support did tell me that my ex can collect past due child support. I just don't understand what klnd of person would do this, it is just so sick, it makes me sick. I would have pay child support if I had been working, and had a case open. No problem. But he didn't even give me a chance.

Absolutely. Anytime someone's financial status changes a case can be opened. If you were not working before, there would have been nothing to draw from. Inheritance is taxable income for the calendar year that it was obtained. My advice to you is that the following year YOU request a child support hearing because you will be able to decrease your payment as your income will have decreased.

Child support is exactly that child support so that your child can have the things he or she needs. If you haven't been supporting your child for 13 years, and your coming into some money why not pay it if you owe it. Also just to let you know when AFDC finds out you have an inheritence they will also come after you for monies they gave you while you were not working. Are they wrong too? I think if the tables were turned you would go after your ex for back child support also. I think you should be more than happy to finally be able to give your child the support he or she deserves, and be thankful your ex has been able to keep up on his own all this time. I think you are being quite selfish.

I dont know why people do not want to support their children these days, if your ex pays for your child , tends to their needs, keeps a roof over their head, then you should be willing to take your inheritance and give back. Children are expensive. Child Support is for their part of the House Payment, Car , Gas to take them to things, Power and Water, Food and Clothes. This is expensive. My Ex isnt paying me anything either and its not fair. You brought this child into the world now pay for it . Or sign papers stating you give up parental rights . Its not fair and it wouldnt be fair if it was vice versa. Living is hard these days and everything is high. If you arent able to work - be willing to take that inheritance and pay . Have a good day.

My question is where were the funds to support your child for the past 13 years coming from? If your child collected anything from welfare you ex may have HAD to file for back support in order to repay welfare. Welfare in California is no longer a free ride.

we are obligated to pay for our children's support, ask me i know! and i'm a woman.

i am on disability and they can't take my money, either, but i try to send a little once in a while, anyway. i would be happy to get it all up to date (i only owe about $600 in arrears, though), and i'd gladly do so if i had an inheritance coming in.

you might be aware that, i fyou get an inheritance, your AFDC might go by the wayside for a while... check into that, too.

consult a paralegal who is familiar with family law, for a better answer.

It is sick that a parent would sit on welfare and NOT pay child support! You should have been paying support for this child all along, and whether he asked for it or not, as a parent it is YOUR responsibility to care for your child! Yes, they can take your inheritence and you should gladly give it to your child!

This happened to my husband, too. His ex closed the case when she got her a new man and then 2 years later when they broke up, she wanted child support again. She couldn't get the back support because she had closed the case herself.

Well now you wont have to worry about it. You son will get the money required to care for him. His mother has to ensure that he has everything he needs regardless of how difficult life is at the moment for her. She never should have to ask for child support, any parent should know if you have a child they require money to care for them. Good luck and God bless****

I don't understand why YOU didn't establish child support or support your child financially...THAT makes no sense.

Suck it up and pay it. If you won the lottery the same thing would happen.

he absolutely has a right to child support, u needed to be paying all along for your child. he can collect.
