Actually you can give the baby ANY last name you want. You can give the baby a last name that neither of you have, if you wanted. When the baby comes, your the one that fills out all the forms. All the father does is sign that he is the daddy.

YOU CAN just give the baby your last name the fathers name can also be on or off the record.
Don't let them bs you ! As a matter of fact you can even give the baby his own last name lol. If you have any questions just ask the person who gave you the form to fill out.

Where I live (Canada) the law specifically states that if the parents can not agree on a last name then the baby's last name will be the mom's last name hyphenated with the dad's last name AND the names will be in alphabetical order.
So if Mr. Smith and Ms Jones have a baby, and one or the other will not sign that they agree to the last name the baby will be "Baby Jones-Smith".
No if Mr Smith and Ms Jones agree then they can name the baby "Baby Smith", "Baby Jones", "Baby Jones-Smith", "Baby Smith-Jones" or even "Baby SomethingMadeUp".
Now that is Canadian law, and local laws may differ. Go to a hospital and ask for a copy of the birth registration form, or from city hall. It should have the rules spelled out clearly.

Actually, you can give the baby any last name you want. Doesn't even have to be yours or his. I was in a similar situation, so I gave my baby my mother's maiden name. According to the SS administrators, a child can have ANY name you wanna give it. And the choice is 100% up to you, not the father.

Yes, even though he is on the bc the baby can have your last name. My bf and I chose that my daughter have my last name even though he is on the bc. It is what ever you put on the application will be the baby's name. Now, he may give you a hard time about it if he is there while you are filling it out.

I know when i was naming my 2nd child. I had so many questions. i was no longer with the father and i wanted my son to carry the same last name. I asked the nurse at the hospital and she told me it was my choice. and the dad was not on the birth certificate. Now if he signs the birth certificate you have to come to some type of mutal agreement. If all else fails you can always do a name change later. I had my last name changed when i was 6. Because my mom had those kind of problems when i was born. Ultimatley its up to you.

I live in Canada too, and I know for a fact that you can if the father agrees, change it to just your last name. It is still legal for it to be hyphenated so you can go with Smith-Falle if you want.

You can give the child whatever last name you want, but...the fact that their insistence that the baby have his last name makes you want to only give it your last name instead of both makes me think this is sort of a power struggle. I think hyphenating is completely acceptable, a good compromise, and no one gets excluded. It can have yours, but why should it ONLY have yours?

Just talk to your husband. Explain to him why the baby should have your last name. If he still doesn't agree on your last name, have him explain why the baby should have HIS last name. And make him have a better answer than 'because that's what you do.'

Check the rules in your state, but I don't think there is any requirement one way or the other. The mom is often the one who fills out the birth certificate. If there's no law otherwise, fill it out however you want.
