Do I have to hire an attorney? Does the house need to sell first? I've never been in this situation before. Help!

Yes; you should get a lawyer. Have the 2 of you decided to sell the house and split the $ in half...or what? Could you please be more specific?...because there are different routes you can take...depending on your and or the other homeowners situation(S)--for example(did you both pay for the house-put equal amounts of $ into the house?);(does 1 of you just want out; take a loss on house?); (are bpth of your names on the title?); (who has possession of the title?); (do the 2 of you OWN the house outright, have a mortgage, or a lien on the house?) etc..

Try to come to an agreement with your partner otherwise yes get a lawyer. If there a things that you really dont want your partner to have then get them out before everything goes to crap.

Tell them they're not going to screw you over on anything and either they pay you 1/2 the value or sell out to you.
