Hi, yess i know what your thinking im insane, but it's true for the past couple of days, i have been working for 13 hours a day and i am only 15 years old!! I tried to get a job at petmart, me and the manager talked for an hour, and the last question she asks me is my age??? She should have before, i said 15 she said she won't hire me. That kinda seems fair, only it took an hour, the job was done and i was just about to get it??? Well that is acceptable but what isin't is the fact that now that i have no alternative job, i have to go back working in the killing frying hot sun, with no means of protection from it, except what you can do for youseld at home (they dont give any form of protection, tents or anything) The job is berry picking, usually it is that you work how many hours u want right? But it is very different. They expect u to wait 13 hours, because the truvk to weigh our berries comes at 8:30pm and we usually start work at 7:00am or 7:30. Is this legal? (Con't in details!)

Is this way beyond the limit for a tennager, mabye even an adult, one thing's for sure, it sure is harder than sitting in some office, doing something on a computer, and if you think that's hard, wait till you use all those hours in the beating hot sun. I am amazed no one else working at the place thought of ever wondering that they are being overworked (if i may make it clear, i am the only teen there) Also, if you wanted to leave early, u can't because your stuff wound't be weighed (say u worked 5 hours, it would be taken or weigh less because your berries melt in the sun and they would be there for about 8 hours more) Furthermore, i calculated that the average person workling here makes $4 an hour, and that's if you really work hard!!!!!! I cant take it no more, so i need advice on what to do, perhaps i could get out of this mess, and find a proper job !!!!!!!!

There is no limit on hours for adults. Is there a reason you can't start working later in the day? Is there a reason you can't quit working before the trunk arrives. If you can't work a shorter shift, and you can't legally work the hours the job requires, the LEGAL solution is for you to lose the job.

NOTE: The Petmart job and the berry picking job are in no way related.

Migrant farm workers or permanent farm workers are not covered by DOL wage and hour policy as their work is by the piece. Therefore, based on the facts of your post, the practice is perfectly legal.

I can tell you, I chopped cotten and picked tomatoes in the San Joaquin Valley back in 1968 to 1970 standing on the street corner in Merced California at 4:30 a.m. each saturday and sunday and if I was lucky, I got picked to work that day.

We made $0.25 per bushel for the tomatoes and $3,00 an hour for the cotton and you're right, it's back breaking work.

But at 15 there's not much else. So wait it out for a year and then go reapply to petsmart.

Hours restrictions on agricultural employees :
The hours restrictions are the same for all youth, migrant children as well as local resident children.

right here is the tips i got here across: Breaks and nutrients workers decrease than 18 years of age ought to obtain a minimum of a 30-minute duty unfastened meal era whilst working a shift extra effective than 6 hours in length. Breaks of shorter length at the instant are not required. If an organization supplies breaks of decrease than 30 consecutive minutes in length, the ruin time will count number as paintings time. Wisconsin regulation does not require that employers grant short relax classes, espresso breaks or meal classes for grownup workers, even nevertheless the dept recommends, in financial disaster DWD 274.02(2) of the Wisconsin Administrative Code, that employers gain this. Employers are inspired, yet not required, to grant breaks of a minimum of half-hour in length at situations particularly on the component of the universal meal era. Such concerns are to be desperate today between the organization and the worker. Employers ought to pay workers for "on duty" meal classes. An "on duty" meal era is one the place the worker isn't presented a minimum of 30 consecutive minutes unfastened from paintings, or the place the worker isn't unfastened to pass away the organization’s premises. Employers will possibly not deduct from a workers wages for any time without work of decrease than 30 consecutive minutes. as much as date September 21, 2009 via the equivalent Rights branch for extra tips touch the branch at ER tips.

Its legal just quit. And if you can't find another job try being a lifeguard they'll probably be able to fit you in. And ask some of your friend to do it to. It's easy and fun. And it couldn't be illegal they even do it at blockbuster and fast food. At least it isn't in the blazing sun.

No it's not legal, no it's not fair, people are being paid so little because they themselves are not legal, and you can expose the boss if you like, but you certainly won't have a job then. Now you know how it feels to be an illegal immigrant.

You should watch the movie, "The Grapes of Wrath". It's an old black and white movie with Henry Fonda. History repeating itself.
