Have I done it? Yes. I have even towed a boat to a beach while holding the pivot bar in my hands. That was not done recently, and it was far from safe to do it, but I doubt it would be permitted anywhere today.
Depending on where you are, riding in the back of a pickup may be permitted or it may be illegal.
If it is illegal then you will find the driver is subject to a fine and the rider may also be subject to a fine.
If it is illegal, and something goes seriously wrong, the insurer may refuse to cover the injury, and the driver will be held responsible for all medical expenses and any legal actions that follow.
In some areas you can legally do it if you have seats that are permanently installed in the truck bed and they must be fitted with seat belts.
If you are unsure of what is allowed where you are, ask a local police officer.
