differently...I think people would not commit as many crimes if we would punsih them an eye for an eye.....and a tooth for a tooth. For instance you shoot someone than you get shot...you rape then you get raped...etc. People may look at commiting crimes differently.

Because we decided way back in 1787 that "cruel and unusual punishment" would be outlawed in our society. Yes, folks might think twice about the crime before they commit it, but we as a nation would be a country of barbarians. Not a trade off the founding fathers wanted.

Because what about accidents? Or negligence?

We do not go by that rule because it is too hard to keep uniform. Say someone shoots another in the arm and the person is hurt pretty badly but they survive. So the punishment would be to shoot the shooter but what if they person dies? Then the punishment doesn't fit or equal the crime.

That doesn't really work though - if you embezzle $3 million from a company you get embezzled for $3 million whether you have a company or not? If you shoplift your shop gets lifted?

How about things that are against the law but aren't a direct harm to an individual or organisation - taking drugs, speeding etc?
