I am the sole heir, but my Dad did not leave a Living Trust or a Will of any kind.

My Dad had no debts of any kind and the property is owned "free and clear" I am the only heir, and anxious to sell the property. Dad died without a Will or Living Trust.My Mother preceeded him in death.

I hate to tell you, but this could take a couple of years. I've got cases on my desk now that have been waiting over 2 years for the Estate to be closed out. It's frustrating, but we can only move as fast as the courts do. You may be done sooner being the only heir if nobody is contesting the matter. Good luck, but be prepared for the long haul.

It is more likely that the court will sell it in order to pay off his debts. It will take anywhere from 6 to 18 months to get through Probate. There isn't anything you can do about it.

A will is "probated"...since he didn't have one, the house cannot be "in probate"...he died "intestate" (meaning "no will")...therefore, it may be up to the courts what happens to his "estate"....each states laws are different. I would go and talk to someone in your local clerk-of-courts office..and they can advise you as to what happens now...if he had any outstanding debts, his estate (as in his home) may be sold and any monies received would have to go to settle those debts before any "inheritance" is paid.
