It is not kidnapping if there still is no court order in place. Is he on the birth certificate, then he has the legal rights to do what he wants, but you should contact the police and explain to them the situation and see if there is something they can do to help locate him an the daughter so that you have a contact. I would not waste time I would go to your local police and do whatever it is to get my child back no questions ask....

You must be going out of your mind with worry and I'm devastated on your behalf. The first thing i think you should do is call the police and make a formal report that your child has gone missing. Give them as much relevant information about your case as you can. I'm not sure what part of the world you are from but see if you can also get an emergency appointment with relate, they are not just their for married couples they are there to offer good sound advice not only to help you deal with this hellish situation but also to help you find strategies to cope with future happenings. Why haven't you gotten in touch with your attorney? Also, if his appointed time with your child is over, you have EVERY RIGHT to call the police and have him locked up and your child picked up and returned to you. If you do not enforce the visitation correctly from the beginning, he will never respect the rules. He seems to be more interested in revenge than taking good care of your daughter. This will certainly be grounds in September to have all of his visitation changed to supervised (if he is allowed to see her at all). He has really done a stupid thing here.
While it is fresh in your mind, write down all times and dates of any of his threats, any late returns of your daughter, and find out who actually has your daughter now. I'll bet you that he has given her to someone else to look after. Document all of this so that you can show the court he is unfit to have unsupervised visitation when you are in front of the judge in September. All of this adds up to him using your daughter to hurt you. This is not the action of a caring parent.
IF you allow him to get away with this now, it will be repeated over and over... and your daughter could very well be hurt in the process.

P.S. I'm sure she means well, but 'Melody J' is wrong. There ARE TEMPORARY ORDERS in place and they are just as enforcable as permanent orders. Make sure that you get them enforced. Your daughter's safety is paramount!!

go to the police department anyway. you can talk with someone there and let them know about the situation, and that he's disappeared with the child.
at least it would be on record... i'm sure the police will help if they can.
i'm sorry you're going through this.
i think that you might consider talking with someone at the State Highway Patrol, too.

Get an attorney and a damn good one. If you already have one, maybe you need a detective to help track down your child. Whether there is a "no police" clause in the order or not, your ex took your child and you have the right to your child. Good luck.

something doesn't sound right and what your ex is doing may be illegal seeing as he is not answering your calls and emails. seriously, don't wait...do it now before it gets tougher to track him down. good luck to you.
