I do not believe you have the authority to change your daughter's last name without her father's permission and an order from the court.

I used to work in Family Law. My understanding was that in order for you to be able to change your child's name, both parents must be in agreement. Naturally, all of this would take place after a "Suit Affecting the Parent-Child Relationship" is filed (this is after a divorce, of course) and an agreed order would be signed by both parents to permit the change of name. If the father disagrees or the mother, the name change will not happen. It is the responsibility of the parent bringing the suit to prove that the name change is a necessary one. I would think that if the person paying child support wanted to do so, they could hold matters up in order to get out of child support, or at the very least, pay less child support.

For some reason that I have never understood, the parent paying child support never seems to understand the money is for the CHILD. Even though that parent may not have as much direct input in the child's life any more, the money is very necessary for the CHILD, not the ex-spouse. The money helps very much for the child to have some of the necessities of life. It is a poor substitute for having an in tact family, but at least it helps some.

If you live in the U.S. then you will need to file a petition for name change. Because it affects the child, the father will be required to be notified.

At that time he can contest the name change and will most likely win unless you can show the court compelling reasons why the change should occur.

If you just legally change her name, you can still collect child support.
If your new husband or partner is adopting her and that is the reason for the name change, then no more child support.

The only way support could stop would be if you remarried & your new husband "Adopted her". So, till shes 18, support will come to you for your daughter. And yes you can get remarried too (just do not let your new husband adopt her), and yes you can change her name as well.

Nope that does not mean that. Biologically your daughter is still her father's child. But to protect yourself in a potential ugly battle, have an illegitimate reason after all the father might want them to have his surname. mention why you want to do it and tell him you are doing it do, don't let him find out by chance

you have to take the "father" to court for child support and if he denies paternity then they do a dna test and then have proceedings to determine how much child support you should receive. You do need a lawyer for this.

Audra, don't do that. Her father will always be her father even though he wants nothing to do with her or you. Just make the best of the situation. Don't make it worse. Like I told you before in your previous question, you need to choose a better partner to have a baby with. Plus, you're too young to be having all these babies. Don't you want to enjoy life too?

no, not unless by changing her name, you mean some other man adopting her. then, you couldnt get a penny. if the father signed the birth certificate, he would have to consent to changing her name.
