to try and gain custody of this child? I guess my question is would the court take into account the fact that she gave up one child when looking into the "best situation" for the child?

If the second child is also yours, you might be able to get the judge to order up a psychological to see if she's fit or crazy. She shouldn't be getting pregnant if she couldn't take care of the first one. HOWEVER, if she's pregnant from another man and has moved on with someone else, you need to back off.

It depends on length of time since the first pregnancy and how much/if her situation has changed (ie - is she better able to care for a child).

Good for you for stepping up and offering to raise the child.

no because the situation then and now are two different times and unless she does something to endanger her or the unborn child there is nothing the court would do

it willbe considered but may not have any effect on new seperate case. Things change over time and may no longer exist in new case but if reason in 1st case was severe enough and still exists, it definitely will play a part
