Divorces are filed at your local county courthouse and thus in the state in which you (the petitioner) are a resident. For California you need to have been a resident of that country for at least 3 months otherwise I believe you file in your previous county. If you've moved recently you should check the rules for your state/county.

You cannot file outside of your state or county of residency unless you've moved.

timeframe is decided but how long it takes you to fill out the paperwork and whether or not you have an attorney (or someone who knows the system and what to do) although if you can come to a settlement agreement easily then that will certainly speed things up (and no litigation or mediation means no court which means lower attorney fees).

In general the divorce is final 6 months from the date the petition is final. This is given you turning in all necessary papework in that 6 month period so the judge can render the decision final. The paperwork to file the petition is pretty simple so start there (it ain't cheap though in LA county it cost me $230 or something like that).

If you and your ex are trying to do the divorce without an attorney I suggest a book from barnes and noble that is state specific and has all the worksheets you need.

Good luck... getting a divorce is an enormous undertaking without even considering the emotional impact of the paperwork.

You can file in any state you wish to file in however it will cost you more to do so. I filed in New York State although I lived here because we were married in New York and if I filed in California it would have cost me $3,000.00 just to FILE. That doesn't include ALL the lawyer fees, and court costs. As far as there not being any disputes, it still takes at least 6 months, and there are ALWAYS disputes, I suggest you ask a lawyer first most give free first time consults and at least find out if it will cost you more to file where you are as well as is it a "no fault state", some states aren't and do require you to go through the court system anyway.

You can file for a divorce anywhere as long as you meet the requirements of that state. Most states require 90 days or 1 year residency in that state before you can file there.

I was married in CA and divorced in Texas. You can file for divorce anywhere. If there is no dispute you can fill out the papers yourself, file them with the court and they will contact you with a court date. Depending on where you are this should take no more than a few months.

you can get divorced ANYWHERE you want. you got married and had it filed that you got married. the paper process is just 'proof' of the marriage, PERIOD!!!

so, you can get a divorce anywhere!!! the important thing is that you don't get drunk and forget what state & city you got divorced.

marriage and divorce papers are PURELY for record purpose!!! you can do either one ANYWHERE!!!

most places have EASY divorce processes for an easy divorce... as long as both of you are willing to stand in front of the county-person assisting you for signatures...

email me if you have any questions....

you need to find out what the resident status dates are for where you live now. In Michigan, you have to be a resident here for 6 months and then you can file.
