has anyone evere had any luck changing a court order?, using this form JV-180 in CA. Case ex. My wife and I were ordered pay half of travel expenses for our son to see his dad in oklahoma, but the Judge was unaware that his dad owes over $11,000 in back child support. We dont have a problem with visitation but paying half of travel expenses when he owes so much money seems unfair. Any info would help...Thank You

Basically, it's a matter of bringing the new facts to the judge's attention. You can use the form, or you can simply file a petition as a motion for reconsideration before the court.

Your best option would be to confirm that you are willing to pay the expenses, but ask the judge to offset what you pay by the amount owed in child support. In other words, rather than you paying and then getting "paid back", the amount due is deducted from what you pay up front.

It's the same as what you are asking for, but that phrasing is more likely to get the result you want.

Wrong form. JV-180 is for Juvenile Dependency matters. That s when Child Protective Services files suit to intervene in the child s life pursuant to Welfare and Institutions Code section 300. In other words, you re not in Juvenile Dependency Court, you generally don t use JV forms. Typically, Family Court forms start with an FL. I don t know which form to use because I m not a Family Law Attorney. I m a Juvenile Dependency attorney.
